We've updated our Privacy Policy

We're writing to let you know that we've made some changes to our Privacy Policy, and that we've added a Cookie Statement to our legal policies. In addition to a number of revisions to make our Policy clearer and more readable, here is an overview of some of the changes:
  • We added provisions in order to comply with the new EU-US Privacy Shield Framework and to make the ways we are complying more obvious. (Numerous sections, but in particular, Section 16)
  • We made general revisions for clarity around the information we collect, including clarifying the difference between information you voluntarily provide to us and information we collect automatically. (Section 5)
  • We made general revisions for clarity around how we do and do not use the information that we collect from you. (Sections 6, 9, 12)
  • We added a California Privacy Statement. (Section 18)
  • Finally, we added a Cookie Statement that explains in more detail how we use cookies and similar technologies.
We encourage you to read the entire Privacy Policy and Cookie Statement, as these documents explain what kind of information we collect and how we use the information you give us.

We've Updated Our Legal Policies

We're writing to let you know that we've made a few changes to MailChimp's Terms of Use, Privacy Policy, and Acceptable Use Policy. Here's an overview of the changes:

We've updated our Terms of Use to improve the billing process for add-ons. We've also made some changes to our sections about compliance to make it clear that you will use MailChimp only in compliance with your applicable laws, which may be different or more restrictive than the laws of the United States, and that you won't use our platform to discriminate in any way.

We've added clearer disclosures about how we collect and treat data related to subscribers in our Privacy Policy. We've also made some updates to accommodate our growing international user base: We made it clear that we operate and store data in the United States, added a separate section for our Australian users, and clarified that we transfer data from the EU under our Data Processing Agreement, which incorporates Standard Contractual Clauses. It's important that every individual whose data we hold knows how to correct, update, or remove the information we have, so we've explained how to contact us and how we treat those inquiries.

In our Acceptable Use Policy, we've updated our prohibited actions section to address some actions that have harmed our system recently. We've broken out our guidelines to clearly distinguish between content that's never allowed to be sent through MailChimp (like illegal activity) and content we allow, but may take a harder look at (like online trading).

Why we're making these changes

MailChimp has grown significantly since our legal policies were last revised about three years ago. We've made some functional changes since then, like offering more features as add ons, and our legal agreements need to be updated accordingly. There are also some restrictions in our Terms that are no longer relevant or accurate, since email and marketing best practices have changed over the years. Finally, some countries have enacted or updated their laws related to data privacy, so to better accommodate the needs of our international users, particularly those located in the EU and Australia, you'll see we've added some sections to our Privacy Policy.

What you need to do

These new Terms go into effect today. If you continue using MailChimp after today, you'll be doing so under the new Privacy Policy and Terms of Service.

As always, you may toggle your privacy and publicity settings to adjust how your data is collected, used, and disclosed.

Making the switch to New MailChimp

This is just a reminder that the old version of MailChimp will be closed next week. On Monday, July 15, we'll start switching all accounts over to New MailChimp.

Here's a quick guide that explains what's new in the app. It includes screenshots and videos that will help you learn your way around New MailChimp in just a few minutes.

We shaved seconds off the campaign building process by making a lot of small changes, but here are a few that might be relevant to you:
Pro mode
We made the global navigation collapsible, so you can switch to "pro mode" and get an additional 100 pixels of workspace for list management and content creation.
Add subscriber
We updated the "Add Subscriber" button and created new dropdown menu actions for each list in your dashboard.
Search
It's now easier to search all your campaigns, lists, and subscribers from anywhere in the app by clicking the magnifying glass in the navigation, or just by pressing "s."
Desktop and mobile
You can now create and send campaigns, view your reports, and manage your list from a desktop or tablet. You can even press "send" on a campaign from a draft in your smartphone.
We'll continue to make improvements to New MailChimp based on feedback from our customers. In the meantime, feel free to reply to this email if you have specific comments or suggestions.

New MailChimp is almost here!

An all-new MailChimp is coming June 17


We have a motto that hangs on the wall here at MailChimp: Listen Hard, Change Fast. We've been listening to you. We've spent countless hours visiting our customers and learning about how you work, and we've used that research to create a new and improved version of MailChimp. It's more efficient, more flexible, and makes for a more collaborative experience. We'll begin rolling it out on Monday, June 17, and we think you're going to love it.

We're excited to share it with you, but we know that change can be hard. Here's what to expect from New MailChimp:

Responsive design


We're introducing a responsive design that's been optimized for tablets, so you can get your work done from wherever you are.

Simplified navigation and subscriber profiles


Account notifications are now displayed in the navigation, so you won't miss out on any important info about your campaigns. Switch to Pro mode to simplify the layout, or collapse and expand menus on the iPhone to create more space when you need it. Search for subscriber details, campaigns, lists, and reports from anywhere in the app. We also made some big improvements to the layout and functionality of subscriber profiles. You can scroll horizontally to reveal all your fields and hide columns you don't need to see, leaving more room for the content that matters.

Comments inside the editor


We talked to a lot of our customers and learned that for most of you, email newsletters are a group effort. New MailChimp makes it easier for teams to collaborate. You can exchange feedback right inside the editor, view comments in real time, and respond whenever you're ready.
Check out our "New MailChimp" blog series to watch some video previews, read about our process, and learn more about what motivated us to redesign the app in the first place.

Starting next week, we'll prompt you to try New MailChimp when you log in to your account. It will be optional until July 15, so you can make the switch on your own terms. Like our normal updates, it will take a few days to become available for all users.

Motion Granted: MailChimp's Redesigned Legal Policies

Thanks for using MailChimp. We're writing to let you know that we've redesigned our Terms of Use and Privacy Policy to make them easier to read and understand. They're also much easier on the eyes now.

You may notice that we've added a few policies. Though very little has changed, we've moved our industry prohibitions, abuse restrictions, and spam rules into a separate document called the Acceptable Use Policy. And developers who use our API should check out the API Use Policy we added.

 

Our goal with this new content is to make our Terms clearer for you—not to make any changes to how we treat you. These policies reflect the same commitment to our customers' privacy and rights that MailChimp has always shown. You own your content, and we'll never sell your personal information or share it in a way that's not consistent with our Privacy Policy. That doesn't change. 

 

Our general counsel describes this update in greater detail on the blog. And of course, we hope you'll take some time to read the policies themselves. These new Terms go into effect today, so next time you use MailChimp, you'll be doing so under the new Privacy Policy and Terms of Service.
